Terms and conditions of use

 

 

The online store www.delacuisine.com (hereafter called "store" or "www.delacuisine.com") is managed by the PHU Studio Projektu Barbara Brzozowska company (hereafter called "company") based in Wroclaw, Poland (NIP: 524-215-94-97, REGON: 021091992).

 

General conditions:

  1. The company sells its products over the internet, through the online store: www.delacuisine.com
  2. Shopping in the store can only be made by people that are over 18 years old.
  3. All the products offered in the store are new and subject to guarantees from the manufacturer or distributor.
  4. All prices mentioned on the online store include VAT.
  5. The price mentioned near a product is the price customer accepts to pay when placing an order. Once an order is done, the price cannot change for this concrete order.
  6. The store reserves itself the right to change the product prices during sales campaigns which has no impact on price of products already ordered.
  7. A proof of purchase (VAT invoice) is added to each shipment.

 

Orders and payments:

  1. Orders are accepted all year round 24 hours a day, 7 days a week.
  2. Orders can be placed through:
  • the shopping ‘cart’ available on the online store: this is the easiest and quickest way to place orders
  • e-mail: customers can send their orders through e-mail to info@delacuisine.com
  • telephone orders are not handled by the store
  1. The store confirms the order by e-mail the same day when the order has been placed. 
  2. Orders will not be treated if they are filled incorrectly.
  3. The store reserves itself the right to cancel an order for two business days once the order is placed.
  4. If the order cannot occur due to a lack of stock, the customer will be immediately notified by e-mail or telephone.
  5. In the previous case, customer decides whether to cancel the order or to agree to the delivery date extension or to agree to a partial order realization if the order consisted of several products. 
  6. Customer may not cancel an order which has already been sent.
  7. Customer can choose the following forms of payment:
  • Payment by bank transfer
  • Payment through Paypal by credit card
  • Payment upon receipt / delivery - available only in some countries (list of concerned countries is available on the "Secured Payment" page of the store)

 

Costs and Delivery

  1. Orders are shipped via UPS Express carrier.
  2. Once customer payment is received by the store, the customer will be notified through email or phone about the approximate time of delivery. Period is counted from the date of order placement till the order delivery estimation.
  3. The customer must pick up the shipment and perform the payment according to the chosen method of shipping.
  4. The client may refuse to pick up orders, if the package or product is damaged (more information can be found in the "Complaints and Returns" section).

 

Privacy Policy

  1. The customer accepts its personal data is used in the scope of its order realisation.
  2. Customer data contained in store's database is used only in this context and can't be in any case transferred to third parties.
  3. Data is stored and protected against access from outside, in accordance with the Act of 29 1997 on the protection of personal data (Journal of Laws of 1997. No. 133, item. 883).
  4. The customer has the right to access, rectify, modify and delete any data in the store.

 

Complaints and Returns

  1. If a product was damaged during transport, the customer must clearly inform the courier and write a statement in his presence indicating the date and time of delivery and providing a description of product damages (or attach a picture). Product exchange is possible only when complying to this procedure.
  2. All complaints will be processed within 5 working days from receipt of the returned order by the store. If a product is defective it will be replaced with a new one. If no new product is available the store offers product replacement by another product of the same category or reimbursement.
  3. According to the law of March 2nd 2002 relative to consumer protection, you can cancel your order without providing any reason within 10 days from the date of product delivery to the client. However this is possible only if the product was not used nor damaged in any way. Client desiring to return of the goods must inform the store by sending an e-mail to info@delacuisine.com. Returned merchandise must be accompanied by the original document attesting sale (VAT invoice) and a withdrawal statement. The store guarantees product refund within 10 days from reception of order return by bank transfer to the account designated by the client.
  4. The customer has to ensure that the returned product is protected from possible damage during transport.
  5. Shipping costs for product return are not refund and are at customer expense.
  6. If the above conditions for return are not fulfilled than the product will be returned to customer at customer expense
  7. Shop will not accept a return if the product was shipped upon receipt of payment mode.
  8. Returns should be sent to the sender’s address indicated on the shipping.

 

Final Provisions

  1. By ordering customer declares that he has read the store's terms and conditions and that he fully accepts them.
  2. Meaningful efforts have been made to ensure that the information contained on the store pages are accurate and current but this information is not covered by any warranty. There is minimal probability that the descriptions included in the catalog pages or images (especially colors of products) might differ slightly from reality.
  3. The store is not liable for any damages on persons related to the use of purchased goods. Guarantee is limited to damages predicted by the producer, the supplier and the importer in the scope of an appropriate use of products. Products have to be used according to instructions mentioned in the user guides.
  4. In case of any dispute not solved in the store’s terms and conditions, parties will seek to resolve the dispute amicably, and if it is not possible, the court that would be chosen to review the case would be based in store's place of residence. The store reserves itself the right to change the terms and conditions at any moment. Any changes will be published on the website www.delacuisine.com
  5. A customer agreeing to the terms and conditions of use accepts all of its terms.
